J1 Froum: Scaming A J1 Visa......totally hypothetical...of course ;)
My friend "BigJoe" went on the J1 last year and was a registered student at the time. However, he is no longer a student now and is going back for the summer. He is entitled to stay for 3 months on a holiday visa but he would like to have the security of getting a job if he needs to also which you cannot do on this visa. All bigJoe needed as proof last year was a letter from his college and stamp which can be got again without to much bother, Imo. Just wondering has anbody been in this situation before or know of any friends like BigJoe who may have got J1's without being in college? He also has his DS-2019 from last year and his social security no.. Would this still entitle him to work this summer? BigJoe can always get a job with some coyboy emmigrant from back home lifting furtiure or painting a house and get paid under the table, but he would rather not travel half way around the globe to hang out with some mucker named "Mick" from galway all summer. Any feedback or comments are greatly appreciated......unless you work for US customs ;)
Actually if he graduated within the last year from college he would now qualify for an internship up to 12 months but it would ned to be within his course of studies. Under the new rules a person may do muliple J1 positions every couple of years. I would not suggest to do anything that may be considered shady as under the new homeland security it is very easy to get caught now if someone does something wrong.
Thank you for your reply. Unfortunatly my friend only completed 2 years of college and walked with just a Higher Certificate in Business studies. I assume it is not possible to apply for an internship with only a level 6 qualification such as a higher cert? Can you tell me if there is any other way that you can stay in the USA for longer than a 3 month holiday visa? Also, do the same immigration laws apply to Canada? He has visited Montreal before and would love to spend some time living there at some stage. Appreciate any more feedback you may have!
Actually dpending on the certficate he may qualify for an internship of up to 12 months. If it was completed less than 1 year ago. The laws for Canada are different and we would not be able to give you a clear answer. We specialize in the J1 process.
